# FCS Music Individual Creator License **Document ID:** FCS-MUSIC-LIC-INDIVIDUAL-001 **Version:** 1.0 — Approved by the owner; outside-counsel review pending **Effective date:** the publication date shown with this document on fullcirclestoryworks.com This FCS Music Individual Creator License (“License”) governs the Track identified on the customer’s FCS license certificate. This License comes with purchases sold **with the FCS Music Individual Creator License** (the creator edition of a Track). A **standard download** (sold without this License) is for personal use only and is governed by the FCS Terms of Service, section 7 (“Standard downloads”), not by this License. This License is issued by **Full Circle Storyworks** (“FCS”) to the individual person identified as the licensee on the certificate (“you” or “Licensee”). ## Plain-English summary This License is designed around **complete individual-use freedom**. You may: - keep the purchased DRM-free file; - make personal backup copies; - listen on any devices you own or control; - edit, trim, fade, loop, remix, and combine the Track with other material; - use the Track in your own videos, podcasts, streams, social posts, websites, and other covered creator projects; - monetize covered projects on channels and accounts you own or control; and - privately share the standalone file with friends or family for personal listening. You may not: - resell or relicense the Track by itself; - upload the raw Track to a stock-music, sample-pack, or competing music library; - make the standalone Track publicly downloadable; - enroll the Track in Content ID or another rights-claiming system; - claim that you created or own the underlying FCS rights; or - transfer your commercial creator rights to the people with whom you privately share the file. This summary is provided for convenience. The full terms below control. ## 1. Definitions **“Track”** means the musical work and/or sound recording identified on the license certificate, including the specific delivered master and approved file versions. **“Certificate”** means the FCS license certificate that identifies the Licensee, Track ID, master or artifact version, license version, order reference, and any other applicable scope. **“Project”** means a larger creative work made or controlled by the Licensee in which the Track is synchronized, embedded, edited, mixed, or combined with other original or licensed content. **“Standalone”** means the Track, or a version that is substantially the Track, distributed separately from a meaningful larger Project. **“Owned or controlled channel”** means a social account, website, podcast feed, stream, channel, or publication account that the Licensee owns or has direct editorial control over for the Licensee’s own creator activity. ## 2. License grant Subject to payment, this License, the Certificate, and any non-waivable law, FCS grants you a: - perpetual; - worldwide; - nonexclusive; - nontransferable; - nonsublicensable license to use the Track in covered individual creator Projects. To the extent FCS controls the applicable rights, this grant includes the rights reasonably necessary to reproduce, edit, adapt, synchronize, distribute, display, and publicly perform the Track as part of covered Projects. This is a contractual license to rights FCS controls. It is not a sale or assignment of copyright, authorship, trademark rights, artist identity, or catalog ownership. ## 3. Permitted uses You may: ### 3.1 Listen and keep copies - download and keep the delivered file without DRM; - play it on devices and systems you own or control; - convert it into reasonable personal-use formats; - maintain personal backup and archival copies; and - use the FCS QA checker to verify file integrity. ### 3.2 Create and publish your own content You may use the Track in Projects you create and publish through owned or controlled channels, including: - YouTube videos and Shorts; - TikTok, Instagram, Facebook, Threads, Bluesky, and similar social posts; - podcasts and podcast video; - Twitch, Kick, YouTube Live, and similar livestreams and archives; - personal or creator websites; - creator reels, portfolios, channel intros, outros, bumpers, and background music; - educational, commentary, documentary, entertainment, and promotional content for your own creator brand; and - other substantially similar individual creator Projects. ### 3.3 Monetize covered Projects You may monetize covered Projects through platform revenue sharing, subscriptions, donations, sponsorships, memberships, affiliate revenue, or similar creator monetization associated with your own content. This License does not by itself authorize paid advertisements for third parties, agency/client work, broadcast television, theatrical film, commercial games or apps, enterprise use, or another person’s brand campaign. Those uses require the applicable FCS commercial, client, sync, or custom license. ### 3.4 Edit and transform the Track You may: - trim, cut, fade, loop, and time-stretch; - change level, EQ, dynamics, or other audio characteristics; - remix or rearrange; - combine the Track with narration, dialogue, sound effects, video, graphics, or other music you are legally permitted to use; and - create excerpts for use within covered Projects. You may use AI-assisted editing or production tools as part of a covered Project. You may not use the standalone Track as a training, fine-tuning, or evaluation dataset for a reusable model or music-generation service without separate written permission. ### 3.5 Share final Projects You may distribute, stream, exhibit, and promote completed Projects without paying FCS additional royalties for the covered use. Platforms may apply their own rules, revenue shares, codecs, takedown processes, or technical limitations. ### 3.6 Private sharing of the file You may make reasonable, private, noncommercial shares of the standalone file with friends or family solely for personal listening. A private recipient receives: - permission to possess and listen to that shared copy for personal, noncommercial use; but - no right to publish, monetize, sublicense, resell, publicly redistribute, register, claim, or use the Track in their own Projects. Private sharing does not transfer your Certificate or your creator license. A public download link, public cloud folder, torrent, file-sharing repository, stock library, or other open distribution is not private sharing. ## 4. Uses requiring another license Unless the Certificate expressly includes them, this License does not cover: - work created primarily for a paying client or third-party brand; - paid advertising or media buying; - broadcast television or radio; - theatrical film distribution; - commercial video games, apps, or software; - enterprise-wide or multi-user organizational use; - resale products in which the Track is a primary feature; - public performance outside ordinary online creator distribution where separate venue or performance rights are required; - standalone commercial remix releases; - sublicensing; - exclusive rights; or - transfer or assignment of this License. Contact FCS for an expanded license. ## 5. Prohibited uses You may not: - sell, rent, lease, sublicense, or relicense the standalone Track; - offer the Track through a stock-music library, sample pack, sound library, template marketplace, download site, or competing catalog; - make the Track publicly downloadable except as technically embedded within a covered Project; - distribute a Project whose primary purpose is to provide listeners with the Track as a substitute for obtaining it from FCS; - register or enroll the Track, any substantially similar version, or its fingerprint in YouTube Content ID, Meta Rights Manager, Audible Magic, or another automated rights-claiming system; - issue copyright claims against FCS or authorized FCS licensees based on the Track; - claim that you wrote, composed, performed, generated, mastered, or own the underlying Track unless a separate written agreement says so; - remove embedded metadata for the purpose of concealing origin or ownership; - use FCS trademarks, branding, or names to imply endorsement; - use the Track in an unlawful manner; or - help another person do what this License prohibits. ## 6. Ownership, nonexclusivity, and AI-assisted material FCS retains all composition, sound-recording, catalog, trademark, and other rights that FCS lawfully owns or controls. Your purchased copy is yours to keep. Your license rights are the rights stated in this License and Certificate. This License is nonexclusive. FCS may license the same Track to other customers and may distribute it through streaming services, stores, partners, or other channels. Some FCS music may be created with AI assistance. FCS grants this License based on the contractual, human-authored, production, and other rights FCS has documented and controls for the offered use. FCS does not promise that a Track is unique, that no similar machine-generated material exists, or that the Track qualifies for exclusive copyright protection in every jurisdiction. ## 7. Credit Credit is appreciated but not required unless the Certificate says otherwise. Suggested credit: > Music: “<Track title>” — FCS Music > Licensed from fullcirclestoryworks.com ## 8. No DRM, downloads, and QA FCS does not use DRM to make the purchased file expire or stop playing. FCS may provide re-download access while the service operates, but you are responsible for downloading and backing up your copy. The FCS QA checker may verify that a file is byte-for-byte identical to the approved FCS artifact. QA verification does not guarantee that your browser, operating system, player, DAC, headphones, speakers, wireless codec, or other playback chain reproduces the file at its full native quality. ## 9. Subscription independence This License and the purchased file are independent from any FCS Listen or other subscription. Starting, changing, pausing, or canceling a subscription does not cancel or downgrade a valid purchased Track or License. ## 10. Platform claims and support FCS does not promise that an automated platform claim will never occur. If a covered Project receives a claim involving rights FCS controls, contact FCS with your License ID, order reference, Project URL, and claim details. FCS will provide reasonable claim-support assistance. FCS is not responsible for claims caused by: - another work included in your Project; - your violation of this License; - your enrollment of the Track in a rights-management system; - a platform rule or technical system outside FCS’s control; or - rights FCS did not claim to grant. ## 11. Refunds and termination The FCS Digital Goods & Refund Policy applies. A replacement file or re-download does not change this License. A duplicate-payment refund leaves one valid purchased License in force. Unless FCS states otherwise in writing, a full refund of your only valid purchase of the Track ordinarily terminates this License and future download access. A partial refund affects only the component identified in the refund notice. This License also terminates if you materially breach it and fail to cure a remediable breach within a reasonable period after written notice. Serious violations—such as standalone resale, public raw-file redistribution, fraudulent ownership claims, or unauthorized Content ID enrollment—may result in immediate suspension or termination. Termination does not erase historical records or excuse prior liability. ## 12. Rights conflicts and legal orders FCS intends to sell only Tracks that pass its rights-review process. If FCS later learns of a material rights conflict, court order, provider restriction, or other legal problem affecting the Track, FCS may suspend new sales and downloads while it investigates. FCS will provide a remedy reasonably appropriate to the circumstances and applicable law, which may include: - corrected attribution; - claim support; - a replacement track; - amended permissions accepted by the customer; - a partial or full refund; or - termination of affected rights when legally necessary. FCS will not silently rewrite the License version printed on your Certificate. ## 13. Certificate and version control Your Certificate is evidence of the License issued to you. It should identify: - your License ID; - the licensed Track; - the master or artifact version and hash; - the license type and version; - the order reference; and - the issue date. The License version issued at purchase governs your rights. Later standard-license updates do not retroactively reduce a valid prior grant, except to the extent required by law or expressly accepted by you. ## 14. Governing terms This License is part of the agreement between you and FCS and should be read with: - the applicable Certificate; - the Digital Goods & Refund Policy; - the FCS Terms of Service; and - any product-specific disclosure shown at checkout. If the Certificate grants additional rights, the Certificate controls for that specific purchase. If a mandatory consumer law conflicts with this License, the mandatory law controls. ## 15.
